Terms and Conditions of Use

VetsFast, LLC (hereinafter VetsFast) is a subsidiary of, and is wholly owned and operated by, Veterinary Medical Professionals, LLC (hereinafter VMP). 

Description of VetsFast

VetsFast is a telecommunications-based veterinary consultation service that is offered and operated by VMP, which facilitates access to veterinary healthcare services delivered by licensed veterinary healthcare providers who themselves operate as independent contractors. VetsFast’s business is primarily in making the arrangements for veterinary healthcare consultations by contracted, licensed veterinarians (“Providers”). VetsFast  provides access to consultations with licensed veterinarians for emergency and non-emergency, episodic veterinary medical care related to common health concerns, through video-based, telephonic, or other electronic encounters (referred to as a "Virtual Visit"). In addition, VetsFast offers services and recommendations to other veterinary clinicians and other ancillary services.

All VetsFast Providers are licensed in the United States. All Providers are physically present in the state in which they are licensed during their performance of your telephonic consultation. VetsFast Providers may not be licensed in your state, provence, region, or country, however, this does not preclude your use of VetsFast Provider services.

VMP is not a healthcare provider and takes no part in the provision of veterinary medical information

VMP does not furnish veterinary healthcare services directly to consumers. VMP operates the VetsFast service which itself facilitates access to veterinary healthcare information delivered by licensed veterinary healthcare providers.

Do not use VetsFast for life-threatening veterinary medical needs

VetsFast is not appropriate to address life-threatening veterinary medical conditions, and should not be used in such circumstances. If you believe your situation involves a veterinary medical emergency, immediately go to a veterinary emergency room or the nearest veterinarian. VetsFast may direct consumers to a veterinarian or veterinary emergency department at any time.

Species Advised Upon

VetsFast veterinarians are primarily trained in small companion animals, specifically dogs and cats. However, as veterinarians, they have all been trained in many species, and each individual veterinarian may or may not choose to give information/advice on any number of species, which may include the following: cats, dogs, rats, ferrets, hamsters, guinnea pigs, chinchilla, rabbits, sheep, goats, horses, cows, chickens and other avian species, snakes and other reptilian species, etc..

Your Obligations as a Client

For any and all animals about whom you discuss with VetsFast, you agree that the medical history which you have provided is relevant, complete, and accurate to the best of your knowledge and ability; that you have answered any questions posed to you by VetsFast in as accurate of a manner as is possible for you to do at the time of questioning, that you have disclosed all medications (whether prescription or not) and nutritional supplements that you are giving or plan to give to the animal(s) in question, and whether or not you plan to breed the animal or if the animal is currently pregnant or nursing.

You understand that all treatments and medications discussed, their forms, dosages, and routes of administration are intended for the hypothetical animal in question and any administration of these treatments and/or medications outside of these guidelines, or to another animal or person including yourself, may cause serious adverse health effects and may be against the law. You understand that accurate and judicious use of any medications or treatments that are discussed is your sole responsibility.

All of the conclusions discussed between VetsFast and yourself for any particular animal should be considered to be speculative/presumptive and failing to investigate some or all of your concerns for any particular animal, in person with a licensed veterinarian, may be deleterious to the health of the animal in question.

Limitations of Service and Non-Guarantee

Insofar as clinical veterinary services are provided to the general public, VetsFast provides a consultation-only service (as opposed to a consultation + direct animal examination service). VetsFast does not at any time represent, attest, or attempt to be a replacement, alternative, or equivalent option for a clinical examination of an animal that is performed in person by a qualified and licensed veterinarian. At no point should you consider the consultation services provided by VetsFast as a replacement for an in-person evaluation of your pet by a qualified, licensed veterinarian.

VetsFast Providers are able to give general veterinary healthcare information/advice only. In order to give specific information regarding a specific animal, a veterinary-client-patient-relationship (“VCPR”) must be established. The exception to this is in the event of an emergency. There is no legal definition of "emergency" is as it relates to the VCPR. VetsFast considers an emergency to be any concern by a client that is immediately urgent to the client. VetsFast Providers do not necessarily determine what qualifies as an emergency and what does not. 

In general, a VCPR can be established via one of three common routes: 

  • a direct physical examination of the animal in question will have occurred prior to their adoption from a breeder, shelter, or any institution/organisation acting as such. 
  • a direct physical examination of the animal in question by any VetsFast Provider
  • a direct physical examination of the animal in question by any veterinarian licensed in the state in which the examination occurred and within the past 12-months. The records of this examination will need to be forwarded to VetsFast for review. 

VetsFast complies with all regulations pertaining to the development and management of a valid VCPR.

VetsFast does not attempt to, nor will ever, provide a final/definitive diagnosis for any animal. Any advice is hypothetical and is based upon the information that you (the client/owner/responsible person) provide to VetsFast. The only exception to this is commentary/information/advice from VetsFast that is based upon medical records from a licensed veterinarian who examined the animal in question and for whom she/he explicitly declared and documented a specific diagnosis (or presumptive diagnosis) that is recorded in the medical record for the animal in question and that this medical record has been reviewed and considered by VetsFast. VetsFast does not prescribe medication or provide treatment for any animal. 

Any medical information or advice transmitted from VetsFast is provided without any representations or warranties as to its relevance, accuracy, completeness, or non-misleadingness; it is strictly general information/advice and is without recourse; any reliance thereupon is at your sole risk. 

If you have further questions, comments, or concerns about any veterinary medical matter pertaining to a specific animal, you should contact a veterinary healthcare provider and have the patient in question examined directly.

A consultation is defined as a period of time consisting of 15 (fifteen) minutes, however, longer consultations are not accordingly invoiced. Consultations via text or email have no defined time component. Clients are encouraged to consult via a voice telecommunication modality for expedited service. Consultations may be terminated at the discretion of VetsFast if the Provider feels that all relevant/pertinent information has been presented and that attempts to facilitate client-understanding have been adequate for the average person. “Unlimited consultations” is defined as no more than 3 (three) consultations (or 45 minutes of consulting time, whichever is reached first) from any single client per 24 hour period. Unlimited is thus further defined as 1,095 consultations (or 16,425 minutes) in a 365-day period. Any perceived abuse of this service or the service offerings by a client as determined by VetsFast may result in termination of services to the client. 

During times of high network congestion the Provider may assign a relative degree of urgency to clients’ enquiries to decide the order in which each enquiry will be dealt. In such a case response to any particular enquiry may be postponed for an indefinite period of time not to exceed six (6) hours.

The number of individual animals about which a Provider will consult is limited to two (2) animals for any client who purchases a single consultation and three (3) animals for any client who purchases an unlimited service plan. 

Providers are veterinarians licensed in the state/region in which they are located and providing consultation services through VetsFast. Providers do not possess infinite knowledge about every possible veterinary-related topic and thus may not be able to address a particular enquiry to the extent that it satisfies the client. When reasonable Providers may further research a particular enquiry in order to provide a more satisfactory response to an enquiry, however, they are not obligated to do so. In cases where a Provider cannot readily respond to an enquiry to the extent that it satisfies the client, the client may be directed to a more complete information source. 

Medical Records

VetsFast creates and maintains medical records of every patient that has been consulted upon or any patient for whom VetsFast receives medical records for. A client has a right to receive, at no charge, a copy of their pet’s complete medical record as held by VetsFast. VetsFast will make reasonable efforts to provide the medical record to the client within 5 (five) days of the clients request (or in accordance with the presiding relevant legislature of the Provider’s licensing state/provence/region/country). VetsFast will send the medical record to the client either vie email or post. 

Indemnification

You understand and agree that you are personally responsible for your decisions, actions, and behavior on the VetsFast website and anytime during your use of/interaction with VetsFast, their services, and employees. By engaging in and accepting services which have been provided by VetsFast you, your assignors, executors, and administrators, agree to indemnify, defend and hold harmless, as well as fully release and discharge VetsFast LLC, its parent company Veterinary Medical Professionals LLC, any subsidiaries, affiliated companies, joint ventures, business partners, sub contractors, providers, licensors, employees, agents, and any third-party information providers from any and all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages) demands, and causes of action by reason of neglect, unintentional malpractice, injury, or whatever relatable incident(s) that has/have occurred, or may occur to the person or their or any relevant pet/animal as a result of, or in connection with the receipt of services; you agree to hold VetsFast LLC and any employees or parent/associated company thereof free and harmless of any claim or suit arising therefrom, including reasonable attorneys' fees resulting from or arising out of your use of, or inability to use, the website, your use of VetsFast services, or any violation by you of this Agreement.

Any communication whatsoever between yourself and VetsFast or its affiliates, employees, or any relatable legal entity, does not necessarily create nor serve to maintain a doctor-client-patient relationship (a.k.a. veterinarian-client-patient relationship; VCPR). Any communication should not be taken as a replacement for personalised veterinary medical advice and should not be relied upon as such. Any medical information transmitted from VetsFast is provided without any representations or warranties as to its relevance, accuracy, completeness, or non-misleadingness. Any advice transmitted from VetsFast is strictly general advice and is without recourse; any reliance thereupon is at your sole risk. If you have further questions, comments, or concerns about any veterinary medical matter relating to a specific animal, you should contact a veterinary healthcare provider and have the patient in question examined directly.

Pharmaceutical Information:

Every effort has been made to ensure that the information provided is accurate, up-to-date and complete, but no guarantee is made to that effect. In addition, the drug information transmitted by VetsFast may be time sensitive and should not be utilized as a reference resource beyond the date hereof. VetsFast does not endorse drugs, diagnose patients, or recommend therapy. VetsFast information is a reference resource designed as a supplement to, and not a substitute for, the expertise, skill, knowledge, and judgement of veterinary healthcare practitioners who have fully examined and subsequently diagnosed your pet. 

The absence of a warning for a given drug or combination thereof in no way should be construed to indicate safety, effectiveness, or appropriateness for any given patient.VetsFast does not assume any responsibility for any aspect of healthcare administered with the aid of information that VetsFast provides. The information contained herein is not intended to cover all possible uses, directions, precautions, warnings, drug interactions, allergic reactions, or adverse effects. If you have questions about the substances you are administering to your pet, check with your veterinarian or animal poison control center.

Notices

You agree that we may send to you in electronic form any privacy or other notices, disclosures, reports, documents, communications or other records regarding the services (collectively, "Notices"). We can send you electronic Notices: (1) to the e-mail address that you provided to us during registration, or (2) by posting the Notice on the applicable service or otherwise through the website. The delivery of any Notice from us is effective when sent by us, regardless of whether you read the Notice.

 

General terms and conditions

All of the content featured or displayed on the website, is owned by VMP, its licensors, vendors, agents and/or content providers. All elements of the website, including without limitation the general design and the content, are protected by trade dress, copyright, moral rights, trademark and other laws relating to intellectual property rights. The services and the website may only be used for the intended purpose for which the website and services are being made available. Except as permitted by copyright law, you may not modify any of the materials nor may you copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information or work contained on the website. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify VMP trademarks in any way, including in advertising or publicity pertaining to distribution of materials on the website, without VMP’s prior written consent. You will not use VMP’s or VetsFast’s name or any language, pictures or symbols which could, in our judgement, imply VMP’s or VetsFast’s endorsement, without prior written consent. You will not remove any copyright, trademark or other proprietary notices from material found on this website.

We attempt to ensure that information on the website and that which is transmitted from our Providers is complete, accurate and current. Despite our efforts, information may occasionally be inaccurate, incomplete or out of date. We make no representation as to the completeness, accuracy or currency of any information on the website or that is transmitted from our Providers. From time to time, the website may contain links to web sites that are not owned, operated or controlled by VMP or VetsFast or any affiliates. All such links are provided solely as a convenience to you. Neither VMP nor VetsFast, nor any of their respective affiliates endorse, guarantee, or make any representations or warranties regarding any other web sites, or any content, materials or other information located or accessible from any other web sites, or the results that you may obtain from using any other web sites.

You agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the site or any activities conducted on the website; or (iii) bypass any measures we may use to prevent or restrict access to the website.

Any of the terms of this Agreement that are determined to be invalid or unenforceable shall be ineffective to the extent of such invalidity or un-enforceability, without rendering invalid or unenforceable any of the remaining terms of this Agreement or affecting the validity or enforceability of the Agreement as a whole. Failure to insist on performance of any of the terms of the Agreement will not operate as a waiver of any subsequent default. No waiver by VMP or VetsFast of any right under this Agreement will be deemed to be either a waiver of any other right or provision or a waiver of that same right or provision at any other time. You agree that these Terms of Use and all incorporated agreements may be assigned by VMP or VetsFast to a third party as determined by us in our sole discretion.

This Agreement shall be binding upon and inure to the benefit of each of the parties and the parties' respective successors and permitted assigns. VetsFast is designed and made available to residents of the United States only. By visiting the website or accessing VetsFast services, you agree that the laws of the State of Washington, without regard to principles or conflict of laws, will govern this Agreement and any dispute that might arise between you and VMP or VetsFast. Any dispute relating in any way to your visit to the website or use of VetsFast services will be adjudicated in state or federal court in the State of Washington and you consent to exclusive jurisdiction and venue in such courts.

 

Privacy Policy

Your privacy is of the utmost importance. The following Privacy Policy applies to information that is collected in the course of your use of VetsFast, as well as any related applications or services.

VetsFast uses the personal information we collect from you to enable the features you are using and provide the services that you request. We might also use the information to request your feedback; to improve the service; to provide you with advance notice of events; or to tell you about new or additional service offerings. Except as described in this Privacy Policy or as specifically requested by you, VetsFast will not disclose, share, or sell any personal information it gathers from you to any third parties outside of its affiliates and contractors.

 

Personal information you choose to provide to VetsFast.

In the course of using VetsFast, there are times when you may choose to share your personal information.

 

Sign-Up Information. 

You provide us with personal information, such as your name and email address when you request services from VetsFast.

 

Contacting us. 

If you email us at help@vetsfast.com, we may ask you for information such as your name and email address so we can respond to your questions and comments. If you choose to correspond with us via email, we may retain the content of your email messages, your email address and our response to you. In certain cases, and only with your express permission, we may post content from your emails to our websites.

 

Surveys and market research. 

VetsFast is committed to constantly improving our services. To support this commitment we may occasionally ask users of our site to complete online surveys, or to participate in online or in-person feedback meetings. If you choose to participate in one of these activities we may ask you to enter personal information. The information you submit may be used to measure the effectiveness of our website, services and content.

 

Information about your use of the VetsFast website and applications.

When you visit our website or use a mobile application, we may collect information regarding your visit from your computer or mobile device. Such information helps us to determine information about how you found our site, the date that you visited, and what search engine may have led you to our website. We collect this information in order to continually improve and enhance VetsFast's services.

 

Log Data. 

When you use the VetsFast website, our systems may automatically record information from your computer or device, its software, and your activity on our site. This may include the Internet Protocol ("IP") address, browser type, the web page visited before you came to our website, information you search for on our website, identification numbers associated with your devices, your ISP or mobile carrier, date and time stamps associated with transactions, system configuration information, and other interactions with our service.

 

Cookies. 

We may use "cookies" on or in connection with our website to collect and maintain information about you. A cookie is a very small text document, which often includes an anonymous unique identifier. We may use cookies to make the website more convenient, to better understand how you interact with our site, and to monitor aggregate usage and web traffic routing. Most web browsers can be adjusted to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. Refusing cookies will not impair your use of VetsFast.

 

Clear GIFs. 

We may also use "Clear GIFs" (also called "web beacons" or "pixel tags") in our website and in our communications with you. A Clear GIF is typically a one-pixel, transparent image located on a web page or in an e-mail or other type of message, which helps us to verify an individual's viewing or receipt of a web page or message. Clear GIFs allow us to know whether you have viewed a web page prior to visiting our website and may enable us to relate such information to other information, including your personal information. We use information provided from Clear GIFs to enable more accurate reporting, improve the effectiveness of our marketing, and make VetsFast better for our users.

 

Analytics. 

Some information we collect using logging and cookies, such as IP address, can sometimes be correlated with personal information. We use this information to monitor and analyze use of our website, for technical administration of the site, and to improve our services and content. Sharing Information With Third Parties Service providers. 

We may use certain trusted third party companies and individuals to help us provide, analyze, and improve our services (including but not limited to maintenance services, database management, web analytics and payment processing). These third parties may have access to your information only for purposes of performing these tasks on our behalf and are under obligations similar to those in this Privacy Policy.

 

Aggregate statistics. 

We may disclose non-personally identifiable aggregate statistics regarding user behavior to third parties in the form of aggregate data or reports, which do not describe or identify any individual user. Information relating to aggregate statistics may be collected through the use of third-party cookies and other third-party tracking devices.

 

Legally compelled disclosure.

We may disclose your personal information if required to do so by law or subpoena, or if we believe that such action is necessary to (a) conform to the law, comply with a judicial or court order or comply with legal process served on us or Affiliated Parties; (b) act under circumstances to protect the safety of users of our website, us, or third parties.

 

Business transfer.

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. In that case we will notify you (for example, via email and/or a prominent notice on our website) of any change in control or use of your Personal Information, or if it becomes subject to a different Privacy Policy. We will also notify you of choices you may have regarding the disposition of such information.

 

Third-party websites.

When you are on the VetsFast website you may have the opportunity to visit or link to other websites, including websites operated by unaffiliated third parties. These websites may collect personal information about you, and because this Policy does not address the information practices of those other websites, you should review the privacy policies of such other websites to see how they treat your personal information.

 

Security

VetsFast takes information security seriously. We use commercially reasonable, industry-standard technical, physical and operational safeguards to preserve the security of your personal information, both when it is transmitted to us and when we receive it. When you enter sensitive information (such as a credit card number) on our website, we encrypt the transmission of that information using Secure Socket Layer (SSL) technology. Video streams used for patient webcam visits are encrypted and are not recorded or stored. No method of electronic transmission or storage is 100% secure, however. Therefore, we cannot guarantee absolute security of your Personal Information.

 

Changes

These Privacy Practices may change from time to time. In the event there are changes in the way we treat your personal information, we will display a notice on the VetsFast website and/or send you an email so that you may review the changed terms prior to continuing to use VetsFast services. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Privacy Practices.
